What does this warranty cover?
This Limited Warranty covers JOOKI players. For purposes of this Limited Warranty, a “JOOKI player” means only the hardware comprising: (a) your JOOKI player device and (b) the peripherals included in the packaging with your JOOKI player device.
How long does the coverage last?
Subject to the terms and conditions of this Limited Warranty, JOOKI, Inc. warrants that its JOOKI players will be free from defects in material and workmanship existing at the time of manufacture for a period of one (1) year from the date of the original purchase (“Warranty Period”). The date of original purchase must be supported by an original sales receipt.
There also may be implied warranties under the laws of some jurisdictions. To the maximum extent permitted by applicable law, such implied warranties are limited to the duration of the Warranty Period. Some jurisdictions do not allow limitations on the duration of a limited warranty, so this limitation may not apply to you.
If your JOOKI player is replaced during the Warranty Period, it will be covered by this Limited Warranty for either (i) the remainder of the original Warranty Period or (ii) ninety (90) days from the date of shipment of the replacement or fixed JOOKI player, whichever is longer.
How do you register your JOOKI player?
You can register your JOOKI player by filling in your name and email address in the Jooki app when you first set up your Jooki.
Who is covered?
This Limited Warranty covers only the original purchaser of the JOOKI player and cannot be transferred to any other person.
If a JOOKI player was given as a gift, as shown by a gift receipt, the gift recipient shall be considered the “original purchaser” of that JOOKI player.
What will JOOKI, Inc. do?
If covered by this Limited Warranty, then JOOKI will repair or replace, at JOOKI’s sole discretion, any defective or malfunctioning JOOKI player or part at no charge except for shipping costs.
You understand and acknowledge that in the event you return your JOOKI player, it may become necessary for JOOKI to perform certain services on your JOOKI player to ensure its functioning. Such services may include the installation of software, firmware, or other updates. You acknowledge and agree that any services provided by JOOKI could change your current settings, cause a removal of customizations, cause a loss of content or data, or cause you to lose certain functionality, and that JOOKI is not responsible or liability for damages resulting from JOOKI’s performance of such services.
What will JOOKI not do?
JOOKI will not provide any monetary refunds or compensation for any JOOKI players, except as set forth in JOOKI’s Return Policy. JOOKI will not recover, install or reinstall any software, data or content.
What does this warranty not cover?
This Limited Warranty does not cover:
- Non-JOOKI products;
- Batteries or battery leakage;
- Used or re-sold JOOKI players, unless provided directly by JOOKI;
- Issues caused by abuse, accident, mishandling, misuse, negligence, or abnormal use;
- Issues caused by using improper voltage or power supply;
- Use of the JOOKI player for anything other than for its intended purpose;
- Issues caused by acts of God, natural disasters, or other external causes;
- Issues caused by improper or unauthorized repair or maintenance;
- JOOKI players that have been altered or modified;
- Internet or telecommunications failures or problems;
- Normal wear and tear (including, but not limited to, cosmetic issues such as scratches, fading and discoloration);
- Commercial use;
- Inadequate packaging or shipping; and
- Any other issues or causes not arising from defects in material and workmanship that existed at the time of manufacture.
This Limited Warranty does not cover any content, data or materials that may be used with and/or stored on a JOOKI player, nor any accessories or peripherals, except as expressly provided for above.
This Limited Warranty will be void if the serial number on your JOOKI player has been removed, altered, tampered with, or rendered illegible, or if you JOOKI player has been opened or serviced without authorization from JOOKI.
JOOKI does not warrant that the operation of a JOOKI player will be uninterrupted or error-free.

What if your JOOKI player is not covered by this Limited Warranty?
If your JOOKI player is not covered by this Limited Warranty, JOOKI will inform you via electronic mail and give you the option to have it sent back to you at your expense or repaired (if possible) or replaced at your expense. If you do not respond to JOOKI’s email, then JOOKI will not send back, repair or replace your JOOKI player.
Sole and exclusive remedy
Your sole and exclusive remedy for breach of this Limited Warranty, and JOOKI’s sole and exclusive liability and responsibility is to either repair or replace, at JOOKI’s sole discretion, the defective or malfunctioning JOOKI player.
This Limited Warranty and the remedies set forth herein above are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. This Limited Warranty is the only express warranty made to you.
EXCEPT FOR THE LIMITED WARRANTY SET FORTH HEREIN AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOOKI AND ITS PARENT COMPANY DISCLAIM ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER STATUTORY, ORAL, WRITTEN, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND AGAINST HIDDEN OR LATENT DEFECTS, AS WELL AS ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE.
No modifications to this Limited Warranty
No employee or representative of JOOKI or its parent or any third party is authorized to make any modification, addition, extension or change to this Limited Warranty.
Exclusion of certain damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER JOOKI NOR OF ITS PARENT COMPANY, NOR ITS OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONSULTANTS, AGENTS OR OTHER REPRESENTATIVES, ARE OR WILL BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF DATA, LOST REVENUES OR LOST PROFITS), UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, PRODUCT LIABILITY, MISREPRESENTATION OR ANY OTHER THEORY ARISING OUT OF, CONNECTED WITH OR RELATING IN ANY WAY TO YOUR PURCHASE OR USE OF A JOOKI PLAYER, EVEN IF JOOKI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PIRPOSE.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
How does State law apply?
This Limited Warranty gives you specific legal rights, and you may also have other rights which may vary from state to state.
Additional terms of this Limited Warranty
If any provision of this Limited Warranty is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Limited Warranty and shall not affect the validity and enforceability of any remaining provisions. No waiver by you or JOOKI of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
This Limited Warranty is valid only in the United States of America and not in any other country or jurisdiction. This Limited Warranty is governed and construed in accordance with the laws of the State of New York, without regards to its principles of conflicts of law that would require the application of the laws of another jurisdiction, though the laws of your state of residence may apply to any tort claims or any claims under any consumer protection statutes or regulations, as provided under applicable law.
